Anti-Corruption Policy in Research and Community Development Activities (Rcd) at Universitas Katolik Indonesia Atma Jaya



I.         The Office for Research and Community Development (IRCD) at Universitas Katolik Indonesia Atma Jaya is committed to the highest standards of ethical behavior and integrity in all research and community development (RCD) activities.

II.       All individuals responsible for conducting research and community development (RCD) are required to behave in a professional manner and comply with applicable laws.

III.     Specifically, the IRCD of Universitas Katolik Indonesia Atma Jaya has zero tolerance for fraud and corruption, including any offer, provision, or receipt of undue rewards, which may be considered as inducements to engage in inappropriate conduct related to RCD activities.

IV.   This policy aims to manage the risks of fraud and corruption that may occur in connection with RCD activities and serves as a key element of the institution’s commitment to combat fraud and corruption. Any violations of this policy will be treated as serious breaches of discipline and/or contractual obligations with IRCD Universitas Katolik Indonesia Atma Jaya.

V.     All RCD personnel acting on behalf of Universitas Katolik Indonesia Atma Jaya are encouraged to report any form of fraud or corruption and to cooperate fully in investigations conducted by the appropriate authorities.

VI.   All reports will be handled with strict confidentiality in accordance with applicable laws and regulations.

VII. The anti-corruption policy is established as follows:

 

1. Definitions

a.     Fraud refers to acts committed with the intent to gain improper advantage or cause harm through deceit or other means, including but not limited to:

b.     Acquiring property, financial gain, or other benefits through deceit;

c.      Causing harm or evading obligations through fraudulent means;

d.     Providing false or misleading information or failing to disclose information when obligated to do so;

e.      Creating, using, or possessing fraudulent or forged documents;

f.        Engaging in bribery, corruption, or abuse of office;

g.     Illegally using computers, vehicles, telephones, or other property or developments;

h.     Disclosing confidential information to external sources.

 

Bribery is defined as the offering, providing, or receiving of undue rewards, which constitute or may be seen as inducements to act improperly in connection with RCD activities.

 

Corruption is defined as the misuse of entrusted power for personal gain. Corruption may range from minor to major offenses, may involve political dimensions, and is generally undertaken for financial gain either for oneself or others.

 

RCD practitioners are strictly prohibited from making or accepting facilitation payments of any kind. Facilitation payments refer to payments made to government officials to expedite approval of a transaction or activity. Such payments or offers are considered criminal acts under Indonesia’s Anti-Bribery Laws and violations under this policy.

 

2. Prohibitions
RCD practitioners at Universitas Katolik Indonesia Atma Jaya are prohibited from:

a.     Offering, promising, giving, soliciting, or receiving bribes. Bribes may take the form of cash, gifts, or other inducements. Bribes may be offered to or requested by private individuals, public or government officials, industry executives, representatives of state-controlled enterprises, political party officials, or private entities, whether directly or through third parties.

b.     Engaging in bribery intended to influence the recipient to act in a certain manner. The action taken by the recipient does not necessarily have to be illegal, but may still be regarded as bribery under this policy.

c.      More specifically, RCD practitioners at Universitas Katolik Indonesia Atma Jaya are prohibited from:

 

1)      Giving, promising to give, or offering payments, gifts, or hospitality with the expectation of receiving some benefit in return, or as a reward for a benefit already provided;

2)    Giving or receiving gifts or hospitality during commercial negotiations or tender processes;

3)    Accepting payments, gifts, or hospitality from a third party offered with the expectation of receiving some advantage in return for themselves or another;

4)    Accepting excessive or extravagant hospitality from a third party;

5)    Offering or receiving gifts to or from government officials, representatives, politicians, or political parties;

6)    Threatening or retaliating against individuals who have refused to pay a bribe or who have reported suspicions of bribery or corruption; or

7)    Engaging in any other activity that may lead to a violation of this policy.

 

Bribes paid under coercion in RCD activities are not considered violations of this policy. In this context, coercion refers to payments made when the payer fears for their safety or the safety of others. All requests for bribes, including those paid under coercion in RCD activities at Universitas Katolik Indonesia Atma Jaya, must be reported as soon as possible after the incident to the Head of IRCD at Universitas Katolik Indonesia Atma Jaya.
